1.Who runs the service
The MineLab99 service available at minelab99.com is run by [to be completed: company name], [to be completed: company address], tax ID (NIP): [to be completed: tax ID (NIP)] (“we”).
Contact: [email protected]. This address is also the point of contact for users and for authorities of European Union member states under Regulation (EU) 2022/2065 on digital services (DSA). You can write to us in Polish or English.
These terms set out the rules for using the service and are the terms for providing services electronically. We make them available free of charge before you enter into an agreement — you can save or print them.
2.Definitions
- Service — the minelab99.com website together with the panel, API and programs we provide (e.g. MineLab Node).
- User (you) — a person using the service, with or without an account.
- Account — your account in the service; you sign in with Google or Discord.
- Parent — a parent or legal guardian of an underage user.
- Server — a Minecraft game server that you create and run in the service.
- Plan — server parameters (e.g. RAM, number of players). The free plan costs nothing; paid plans are paid for with gems.
- SPOT pool — the machines that run free servers: some of our machines and the computers of SPOT program participants. LAB pool — only our own machines, which run paid servers.
- Gems — the service’s virtual currency, used only to pay for services in the service.
- Server page — the public page of your server in the service’s catalogue.
- MineTok — the part of the service with short videos (“moments”) from servers, comments, likes and following.
- User content — everything you publish or upload: names, descriptions, images, videos, comments, server files and worlds.
- SPOT program — a program in which you share your computer to run other players’ free servers in exchange for gems; it has separate terms.
- Consumer — a natural person using the service for purposes unrelated to their business. We also apply consumer rules to a sole trader if the agreement is not of a professional nature for them.
3.Technical requirements and safety
You need a device with internet access and an up-to-date browser with JavaScript and cookies enabled. To play, you need your own legal copy of Minecraft: Java Edition — we do not sell the game or Minecraft accounts.
Using the internet involves common risks such as malware, phishing, account takeover and spam. Protect your Google and Discord accounts and never share passwords or codes — nobody from the MineLab99 team will ever ask for them.
You must not send unlawful content to the service or disrupt its operation (e.g. DDoS attacks, scanning, exploiting bugs). Please report security bugs to [email protected].
4.Account and age
- You can create an account if you are at least 13 years old.
- If you are under 18, you may use the service only with your parent’s permission. Parental permission is also required before every purchase of gems or other paid services.
- By creating an account you confirm that you meet these conditions. If we learn that an account belongs to someone under 13, we will delete it.
- You sign in with Google or Discord — their rules apply too, including their age rules.
- Your account is personal. Do not share or sell it, and do not create more accounts to get around limits or bans.
- The account agreement is free of charge and concluded for an indefinite period. You can terminate it at any time: delete your account yourself on the “Account” page, or write to [email protected] from the address linked to your account and we will delete it for you.
For parents: if you do not agree to your child using the service, or to a purchase your child made, write to [email protected]. We will help delete the account and sort out the payment.
5.Services
In particular, we provide:
- Minecraft server hosting — you create a server, choose a plan, start it and manage it in the panel; a free server goes to sleep when nobody plays and can be woken up;
- demo without signing in — a short trial server, without saving the world;
- server pages — a public page for your server in the catalogue; we check it before publication (moderation); extended page features may require a paid subscription;
- server list and MineTok — the server catalogue, moments, comments, likes and following;
- promotion campaigns — featuring a server, marked “Promoted”, paid for with gems;
- integrations — server page announcements on Discord and connecting your account to an AI assistant;
- wiki and help centre;
- SPOT program — under the SPOT Program Terms.
The current scope of services, plan parameters, prices and limits are shown in the service (in the panel, price lists and wiki). Some features may be in a test version — we mark this in the service.
We keep the world of a server that is not in use for 14 days from its last activity (the panel shows how this period is counted). We send e-mail reminders beforehand. After that the world is deleted permanently — if it matters to you, keep a copy.
6.Free and paid servers: the SPOT and LAB pools
- Free servers run in the SPOT pool: on our machines or on the computers of other users taking part in the SPOT program. The server then runs in an isolated container and players connect through our relay server.
- A free server has no availability guarantee. It may be moved to another machine, stopped or interrupted, e.g. when a SPOT participant switches off their computer. We try to keep the world saved, but we cannot guarantee this if a machine fails suddenly. If a participant’s computer stops responding, we restart the server on another machine from the latest copy of the world — changes made after that copy may be lost.
- Paid servers (LAB pool) run only on our own machines. We take care of their continuity, keep maintenance breaks to the necessary minimum and announce them where possible.
- The files of a free server (world, configuration, console logs) may be stored on a SPOT participant’s computer while the server runs there. Participants are forbidden to access them — more in the Privacy Policy.
7.Gems
- Gems are the service’s virtual currency. They are used only to pay for MineLab99 services: bigger server plans, the 24/7 plan, promotion campaigns and other features priced in gems.
- You can buy gems in packs, receive them as a bonus or earn them in the SPOT program. Pack prices, the bonus size and how it renews are shown in the service.
- Gems are not money or electronic money. You cannot exchange them for money, withdraw them or transfer them to another account. Buying or selling them outside the service is forbidden.
- Purchased gems do not expire as long as your account exists. Bonus or promotional gems may have an expiry date — we show it next to your balance.
- If a payment for gems is refunded or disputed with the bank, the unspent gems from that purchase are removed from your account. If this creates arrears, we may suspend paid features until the matter is resolved.
- We may correct or take back gems granted by mistake (e.g. a system error) or obtained in breach of these terms. We will tell you about it and why.
- Gems have no value outside the service. They are lost when your account is deleted, so use your balance first. This does not limit your consumer rights described in these terms.
8.Payments
- Prices are gross amounts (including VAT) in Polish złoty, unless stated otherwise at purchase.
- Payments are processed by Stripe. You can see the available payment methods on the payment page. We do not store your card details.
- An agreement (e.g. buying a gem pack) is concluded when you confirm the order with the payment button. We provide the service once the payment is booked and send you a purchase confirmation with the text of your consent by e-mail.
- A server page subscription renews automatically for further periods until you cancel it. You can cancel at any time in the page panel — the page stays active until the end of the paid period.
- The 24/7 plan is paid in gems in advance for the whole period; the hourly plan is paid for the time the server runs, according to the price list in the panel.
- We will refund the unused part of a balance top-up in złoty (if this payment method is available) at your request made within 14 days of the top-up.
- Invoices: on request we issue a VAT invoice for a gem purchase — write to [email protected] within 3 months from the end of the month of purchase; the payment confirmation is sent by the payment operator (Stripe).
- People under 18 pay only with their parent’s permission.
9.Right of withdrawal
As a consumer you can withdraw from a distance contract within 14 days without giving a reason. A statement sent to [email protected] is enough; you may, but do not have to, use the model form from the Polish Consumer Rights Act.
We start providing services and digital content (gems, plans, promotion campaigns, page subscriptions) immediately. That is why, before payment, we ask for your express request to start before the withdrawal period ends and for your acknowledgement that you will lose the right of withdrawal once the service has been fully provided. We record the text and version of this consent and send it to you by e-mail.
- If you withdraw before the service has been fully provided, you pay only for what was provided until withdrawal (e.g. gems already spent) and we refund the rest.
- Once the service has been fully provided, the right of withdrawal expires.
- We refund using the same payment method, no later than 14 days after receiving your statement.
Regardless of the right of withdrawal, you always have your rights if the service does not conform to the contract (complaints).
10.User content and rules
You are responsible for the content you publish and for what happens on your server. By publishing content, you confirm that you have the rights to it and grant us a free, non-exclusive licence to store, reproduce and display it in the service (including the catalogue, MineTok, featured spots and thumbnails) for as long as it is published. The licence ends when you delete the content, except for copies we must keep by law.
You must not publish or use the service for:
- illegal content, including content depicting child sexual abuse or inciting violence or terrorism;
- harassment, threats, hate speech and discrimination;
- adult content, graphic violence and inappropriate names, skins or images — children use the service;
- revealing other people’s personal data (doxxing), impersonation, scams and phishing;
- infringing copyrights, trademarks and other third-party rights;
- spam and artificially inflating statistics (likes, followers, players, activity);
- gambling for real money or for currency bought with money, and selling gameplay advantages contrary to Mojang’s EULA and guidelines;
- running anything other than the game on servers: cryptocurrency miners, proxy or VPN servers, bots, attack tools and other workloads unrelated to Minecraft;
- attacking the service, other servers or infrastructure (DDoS, exploits) and circumventing limits, safeguards or server sleeping (e.g. keeping a server artificially awake).
Server owners must follow the Minecraft EULA and Mojang’s guidelines, moderate their server and respond to player reports. More: Community rules.
11.Reporting content and moderation
- You can report illegal content or content that breaks these terms with the “Report” button on a server page or next to a MineTok moment or comment, or by e-mail to [email protected]. A report should include: an explanation of why the content is illegal or breaks these terms, the exact address (URL) of the content, your name or nickname and e-mail (not required when reporting child sexual abuse material), and a statement that the report is accurate to the best of your knowledge.
- We confirm receipt, handle reports without undue delay, objectively and with human involvement, and tell the reporter about our decision if they gave contact details. Child safety cases are handled first, and we notify the competent authorities of suspected crimes.
- We check server pages before publication. An automated tool helps us, but it only makes suggestions to the moderator — a human always decides.
- If we restrict your content or account (e.g. remove content, hide a server, reject a page, suspend an account), we will tell you about the decision, its reasons and legal or contractual basis, and how to appeal.
- You can appeal any decision — including a decision on your report — to [email protected] within 6 months. A human handles the appeal, where possible someone other than the person who made the decision. You can also use an out-of-court dispute settlement body certified under the DSA, or go to court.
- If someone frequently sends manifestly unfounded reports or appeals, we may, after a warning, stop handling them for a period.
12.Ordering of lists, recommendations and ads
The order of servers in the list and of moments on MineTok is set automatically. The main factors are:
- server list — players online and how full the server is, recent activity, number of followers, a boost for new servers, and promotion campaigns;
- MineTok, “For you” tab — likes, comments, how recent a moment is and whom you follow; the “New”, “Live” and “Trending” tabs do not depend on your activity;
- servers and moments from a paid campaign are always clearly marked “Promoted”.
Ads (Google AdSense) may appear on some pages. By default these are non-personalised ads, i.e. not chosen based on your profile. We do not show profiling-based ads to people we know are minors.
13.Violations, suspension and account deletion
- If you break these terms or the law, we may — depending on how serious the violation is — warn you, remove or hide content, restrict features, stop a server, suspend your account, or terminate the agreement and delete your account.
- We may terminate the agreement for important reasons (e.g. repeated violations, closing the service) with 14 days’ notice, and for serious violations (e.g. illegal content, attacks, fraud, endangering children) with immediate effect.
- We always give the reasons for our decision and tell you how to appeal.
- If we terminate the agreement through no fault of yours (e.g. we close a service), we will refund the value of unused purchased gems and the unused part of paid services. Gems obtained in breach of these terms (e.g. by cheating in the SPOT program) are not refunded.
- Settlement of purchased gems when the agreement is terminated through your fault: unspent purchased gems are converted at the purchase price and their value is promptly refunded to the account used for payment, less documented amounts due as a result of the breach.
14.Liability
- We are liable for the conformity of our services with the contract under the Polish Consumer Rights Act and Civil Code.
- Free services (free plan, SPOT pool, demo) are provided as they are, without any guarantee of continuity, performance or data retention beyond what we describe in the service.
- We are not liable for user content or for what happens on servers run by users, unless we fail to act promptly after receiving credible information that content is unlawful.
- We are not liable for interruptions caused by force majeure or by failures of third-party services (e.g. Mojang, Google, Discord, network operators) that we could not avoid, or for the consequences of you sharing your login details with others.
- Towards businesses that do not enjoy consumer protection, we are not liable for lost profits.
- These limitations do not apply to damage caused intentionally or to consumer rights that the law does not allow to be limited.
15.Complaints and disputes
- Send a complaint (e.g. a service does not work as described, gems were counted incorrectly) by e-mail to [email protected]. Describe the problem, give your account e-mail and, if it concerns a server, its name or address.
- We will reply within 14 days. If you are a consumer and we do not reply within this time, your complaint is deemed accepted.
- If a service or digital content does not conform to the contract, you can demand that it be brought into conformity and, if that is impossible or fails, a price reduction or withdrawal from the contract, under the Polish Consumer Rights Act.
- As a consumer you can use out-of-court dispute resolution, e.g. help from a municipal or district consumer ombudsman or the regional Trade Inspection. More information (in Polish): prawakonsumenta.uokik.gov.pl.
16.Minecraft and trademarks
MineLab99 is not an official Minecraft product and is not approved by or associated with Mojang or Microsoft. Minecraft is a trademark of Mojang Synergies AB. Original wording: “Not an official Minecraft product. Not approved by or associated with Mojang or Microsoft.”
The MineLab99 name and logo, the look of the service and our software (including MineLab Node) are protected by law. You may not copy or use them beyond normal use of the service without our consent.
17.AI assistants and integrations
- You can connect your account to an external AI assistant (e.g. via the MCP protocol). Before connecting, you will see what the assistant will be able to access. The assistant acts on your behalf within the scope of your consent — you are responsible for the instructions you give it.
- You can revoke the assistant’s access at any time in your account settings. Using the assistant is also subject to its provider’s rules.
- Server page announcements on Discord require connecting your Discord account and adding our bot to a Discord server you manage.
18.Changes to these terms
- We may change these terms for important reasons: changes in the law, decisions of authorities, changes to the scope or manner of providing services, security or preventing abuse.
- We will inform you of changes by e-mail or in the service at least 14 days before they take effect. If you do not agree, you can delete your account before that date — unused purchased gems will then be settled as for termination through no fault of yours.
- Changes do not affect rights acquired before they take effect — e.g. a paid service period continues under the previous rules.
- Changes required solely by law, or changes in your favour, may apply earlier.
19.Governing law and final provisions
- Agreements are governed by Polish law. If you are a consumer living in another EU country, you keep the protection of the mandatory laws of that country.
- Disputes with consumers are settled by the courts having jurisdiction under general rules.
- The Polish version of these terms is binding. Versions in other languages are for information only.
- These terms apply from the date shown at the top of the page. We will provide earlier versions on request.
